These Terms of Use govern your account and use of Meringue. The Meringue Privacy Policy is a separate document and explains how Meringue handles personal and health information.
Meringue is intended for people 18 years of age or older. By creating an account, confirming your agreement during signup, or using Meringue, you agree to these Terms of Use. If you do not agree, do not create an account or use the service.
Meringue helps you bring together health information you choose to enter, import, view, export and include in reports. Information may come from you, uploaded files or supported third-party sources. You are responsible for reviewing and verifying the accuracy and completeness of information before relying on it, sharing it or using it in a health-related discussion. Imports, transcription, conversions and summaries can be incomplete or incorrect, so keep source records or independent copies when they are important.
Meringue is currently available directly to adults 18 years of age or older who reside in Canada while the service is still evolving. Features may be incomplete, contain errors, change, be removed or become temporarily unavailable. Access may be limited or interrupted when reasonably necessary for maintenance, security, legal compliance or service protection, subject to applicable law.
Creating an account does not make you a tester and does not require you to complete questionnaires or provide feedback. Feedback is welcome and optional. Keep an independent copy of information you cannot afford to lose.
Meringue is a personal health-information organization tool. It does not provide medical care, diagnosis, treatment, medical advice or emergency monitoring, and it is not a substitute for a qualified health professional. Charts, summaries, reports, reminders and other Meringue features are for organization and review; they should not be treated as a medical determination. Do not rely on Meringue to detect an emergency or to alert you that urgent care is needed. If you believe you may have a medical emergency, use the appropriate emergency services or seek qualified medical care.
Meringue processes personal and health information according to the separate Meringue Privacy Policy. You choose what health information to provide, and account creation requires express consent to processing the health information you choose to provide. Meringue may host, process, display, organize, back up and export your information only as needed to operate, secure and improve the service as described in the Privacy Policy and as otherwise permitted by law. You retain your rights in the health information and other content you provide.

You are responsible for keeping your account credentials confidential, maintaining accurate account information and using the security controls available to you. Do not share access in a way that exposes another person’s health information. You must not attempt to access another person’s account, impersonate another user, obtain information you are not authorized to access, or bypass, disable or interfere with Meringue security controls. Please report suspected unauthorized access or security issues promptly. Meringue may take reasonable steps to protect accounts and investigate security concerns, but no system can guarantee absolute security.
Use Meringue only for lawful personal purposes. You must not use the service to commit fraud or unlawful acts; harm, threaten or harass others; introduce malware or malicious code; probe or exploit vulnerabilities without authorization; disrupt or overload the service; circumvent technical limits or security controls; infringe intellectual property or privacy rights; or upload information that you do not have the right or authority to provide. Good-faith product feedback is welcome through the feedback and support channels provided by Meringue.
Meringue owns or licenses the Meringue software, product design, interfaces, documentation, visual identity, name, logos, brand and underlying technology. These Terms give you a limited, personal, non-exclusive right to use Meringue while your access is authorized and in accordance with these Terms and applicable law. They do not transfer ownership of Meringue technology or brand assets to you. You retain your rights in the health information and other content you provide. The rights Meringue receives in your information are limited to the processing needed to provide, secure and improve the service under these Terms and the Privacy Policy, except for the separate feedback licence below.
If you voluntarily provide ideas, suggestions, bug reports, usability observations or other feedback about Meringue, you grant Meringue a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, modify, adapt, analyze and incorporate that feedback into Meringue and related products or services, and to create improvements or derivative works from it, without an obligation to compensate or credit you. This licence applies to the feedback itself and does not transfer ownership of your health information. Do not include unnecessary health information, passwords, access tokens or other secrets in feedback, screenshots, bug reports or support messages. Personal information contained in feedback remains subject to the Privacy Policy.
Meringue may maintain, update, reconfigure, add, limit or remove features as the service evolves, and may interrupt access when reasonably necessary for maintenance, security, legal compliance or service protection. During the early release, availability and functionality may change more frequently than in a mature service. Where applicable law requires notice, consent, a right to refuse a change, cancellation rights or another remedy, those requirements and rights apply. Meringue does not promise that every feature will remain available indefinitely.
You may stop using Meringue and use the available account controls to request deletion of your account and health data, subject to the retention described in the Privacy Policy and any legal obligations. Meringue may suspend or restrict access when reasonably necessary to address a security threat, suspected unauthorized or unlawful use, a material breach of these Terms, a legal requirement or a technical risk to the service or other users. Meringue may also discontinue the service, subject to any notice, cancellation or other rights required by applicable law. Suspension or termination does not change Meringue’s obligations concerning deletion, retention or protection of personal information.
During the early release, and except for warranties, obligations and rights that cannot legally be excluded or limited, Meringue is provided on an as-available basis. Meringue does not promise that the service will be uninterrupted or error-free, or that information entered or imported by you, or generated from that information, will always be complete or accurate. You remain responsible for verifying health information before relying on or sharing it. Nothing in these Terms excludes any legal warranty or mandatory obligation that applies to Meringue.
Liability is governed by applicable law. Nothing in these Terms excludes or limits liability where an exclusion or limitation is prohibited, including liability for bodily or moral injury, material injury caused by intentional or gross fault, or any merchant responsibility or consumer remedy that cannot be waived under applicable Quebec law. Where a limitation is legally permitted, Meringue is not responsible for loss caused solely by your unauthorized use of the service, your failure to verify information that you supplied or imported, or a third-party service outside Meringue’s control, except to the extent that Meringue’s own fault caused or contributed to the loss or applicable law provides otherwise.
These Terms are governed by the laws applicable in Quebec and the federal laws of Canada that apply there, without depriving you of mandatory protections that apply to you because of your place of residence. If the Quebec Consumer Protection Act or another mandatory consumer law applies, nothing in these Terms waives rights that cannot be waived, restricts access to a court or class action where such a restriction is prohibited, or requires a prohibited forum or dispute process. Mandatory law prevails over any inconsistent provision of these Terms.
Meringue may update these Terms to reflect changes to the service, security practices, legal requirements. When applicable law requires advance notice, particular information in the notice, a right to refuse a change, a right to cancel without cost or another remedy, Meringue will provide those rights. The version and effective date identify the Terms that apply. Material changes will not apply retroactively unless permitted by law or accepted by you.
